How we read state hemp law

Under the 2018 Farm Bill (Pub. L. 115-334, 7 U.S.C. § 1639o), hemp meeting the federal definition — Cannabis sativa L. with no more than 0.3% Delta-9 THC by dry weight — was removed from Schedule I and is lawful in interstate commerce. Where a state has not enacted an express prohibition or restriction, that federal definition controls. Many state guides treat silence as ambiguity; we treat it as the federal default, because that is what the law actually provides.

For each state we cite the controlling statute or administrative regulation. Where state law is silent we cite the federal hemp definition. Where a state agency has issued non-binding interpretive guidance — Attorney General opinions, Department of Health letters, police training newsletters — we note it as enforcement risk, not as legal prohibition.

The federal landscape changes on November 12, 2026 when Section 781 of the FY2026 Agriculture Appropriations Act takes effect. We do our best to update this page with material changes within 72 hours of any state or federal action.
